Vium, Inc. (together with our affiliates, “Vium”, “we”, “us” and “our”), takes the privacy of your personal data seriously. This Privacy Policy (this “Policy”) is designed to assist you in understanding how we collect, use, and share personal data and other information you provide to us or relevant third parties in relation to our sites and services.

1.     Applicability

This Privacy Policy governs Vium’s data collection, processing and usage practices. It also describes your choices regarding use, access and correction of your personal information. By accessing our Website, submitting your personal information, or engaging with Vium services or through other means, you consent to the use of your information as set out in this Privacy Policy.

2. Information Collected by Vium
2.1. When You Visit our Website

When you visit the Website we only collect Browsing Information as describe below. We might request that you provide Personal Information for specific Website interactions such as requesting more information or support, for event registrations or for access to exclusive content.

2.2. When You Directly or Indirectly Engage with Vium

If you submit your Personal Information to Vium in other circumstances such an event, a meeting, or any marketing-related activity, we will process your Personal Information in the conditions settled in this Privacy Policy.  Occasionally, we might source personal information from an external third party or a publicly available source. In these circumstances, this Privacy Policy will also apply.

2.3. Personal Information

Personal Information refers to any information that you voluntarily submit to us and that identifies you personally, including contact information, such as your name, email address, company name, address, phone number, and other information about yourself or your business. Personal Information can also include information about you that is available on the internet, such as from Facebook, LinkedIn, Twitter or Google, or publicly available information that we acquire from third-party service providers.

We secure the Personal Information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure.  Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.  We are in no way liable for any direct or indirect damages resulting from the wrongful or unlawful use of your personal data by a third party.

Our Website can include links, hyperlinks, or references to other websites that are not controlled or managed by us and to which this Privacy Policy does not apply. We are not liable for the content of those websites or for the offers, products and services offered by them. 3.4. Onward Transfers
We may share your information as described in this Privacy Policy (e.g., with our Third-Party service providers; to comply with legal obligations; to protect and defend our rights and property) or with your permission.
  • Vendors and Service Providers. We may share any information we receive with vendors and service providers. The types of service providers (processors) to whom we entrust Personal Information include service providers for: (i) provision of IT and related services; (ii) provision of information and services you have requested; (iii) payment processing; (iv) customer service activities; and (v) in connection with the provision of the site. In such cases, our business partner’s name will appear, along with Vium. Vium requires our affiliates and business partners to agree in writing to maintain the confidentiality and security of Personal Information they maintain on our behalf and not to use it for any purpose other than the purpose for which Vium provided them.
  • Disclosures to Protect Us or Others (e.g., as Required by Law and Similar Disclosures). We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) protect yours’, ours’ or others’ rights, property, or safety; (iv) to enforce Vium policies or contracts; (v) to collect amounts owed to Vium; (vi) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (vii) if we, in good faith, believe that disclosure is otherwise necessary or advisable.  In addition, from time to time, server logs may be reviewed for security purposes – e.g., to detect unauthorized activity on the services. In such cases, server log data containing IP addresses may be shared with law enforcement bodies in order that they may identify users in connection with their investigation of the unauthorized activities.
  • Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. In such event, Vium will endeavor to direct the transferee to use Personal Information in a manner that is consistent with the Privacy Policy in effect at the time such Personal Information was collected.
3.5. Retention of Personal Information

We retain Personal Information that you provide us as long as we consider it potentially useful in contacting you on our services, or as needed to comply with our legal obligations, resolve disputes and enforce our agreements, and then we securely delete the information. We will delete this information from the servers at an earlier date if you so request, as described in “Opting Out” below.

3.6. International Data Transfers

You agree that all Personal Information collected via or by Vium may be transferred, Processed, and stored anywhere in the world, including but not limited to, the United States, the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our service providers. Your Personal Information may be accessible to law enforcement or other authorities pursuant to a lawful request. By providing information to Vium, you explicitly consent to the storage of your Personal Information in these locations.

4. Cookies

Vium use cookies to analyze trends, administer the Website, track users’ movements around the Website, and to gather demographic information about our user base as a whole.

By consenting to this Privacy Policy, you are giving Vium, Inc. the permission to process your personal data for the purposes outlined above. You may withdraw consent at any time by opting out as described in Section 6, Opting Out below.

6. Opting Out
6.1. Reviewing, Correcting and Removing Your Personal Information

Upon request, Vium will provide you with information about whether we hold any of your Personal Information. If you provide us with your Personal Information, you have the following rights with respect to that information:

  • To review the user information that you have supplied to us
  • To request that we correct any errors, outdated information, or omissions in user information that you have supplied to us
  • To request that your user information be removed from any solicitation list that we use
  • To request for the data portability of your user information
  • To request that your user information be deleted from our records
  • To opt out of being solicited by Vium as described in provision “Unsubscribe from Our Communications” hereunder.

6.2. Unsubscribe from Vium Communications

You may unsubscribe from our marketing communications by clicking on the “unsubscribe” link located on the bottom of our emails. Unsubscribing to our marketing communications won’t affect any transactional emails related to customer accounts.

6.3. GDPR Compliance

You may direct any inquiries or complaints related to our compliance towards GDPR to info@vium.com. If you have unresolved privacy or data use concern that we have not addressed satisfactorily, you have the possibility of lodging a complaint with a supervisory authority within the European Union.

7. Compliance with Our Privacy Policy

We use the information we collect only in compliance with this Privacy Policy. We will never sell your Personal Information to any third party.

8. Changes to our Privacy Policy

We might update this Privacy Policy from time to time, so we encourage you to review it periodically as it can be consulted at any moment on our Website.

9. International Users

By using the Site, Vium will transfer data to the United States.  By choosing to visit the site, utilize our services or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the United States and the adjudication of any disputes arising in connection with Vium or the site will be in accordance with our Terms of Use.

If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to processing of your data globally.
